Data Controller
Your personal data controller is the Service and Production Company “SKAMER-ACM” Sp. z o.o., located in Tarnów at ul. Purposes of Processing
The personal data you provide will be processed for the following purposes:
- execution of a purchase-sale agreement for products offered by us (to conclude a contract based on your interest in our offer and to fulfil the subject of a contract already concluded with us),
- direct and indirect marketing,
- providing you with marketing information, including personalized marketing emails about products and services available from us or which we believe may interest you. This is optional – we must have your consent to send such materials,
- offering products and services based on our legitimate interests,
- compliance with applicable legal, tax, and accounting regulations,
- pursuing or defending claims as part of the legitimate interests of “SKAMER-ACM” Sp. z o.o.,
- handling complaint processes.
Legal Basis for Processing
- consent given,
- necessity to fulfil a legal obligation of the controller,
- necessity for purposes arising from the legitimate interests pursued by the controller, e.g., responding to your letters and inquiries.
Profiling
When personalizing our marketing communication, we may profile your data, meaning that we can use the information we have collected to tailor communications to your needs. We do not use algorithms that make automated decisions.
If you do not wish to receive personalized offers, product recommendations, or any marketing information, you may object at any time.
Right to Object
You have the right to object at any time to the processing of your data described above. We will stop processing your data for these purposes unless we can demonstrate that there are important legitimate grounds for processing that override your interests, rights, and freedoms, or your data is necessary for the establishment, exercise, or defence of legal claims.
You also have the right to object at any time to the processing of your data for the purpose of directly offering our products and services. If you exercise this right, we will cease processing data for this purpose.
Data Retention Period
Data processed for offering our products and services directly may be processed until you object to such processing or until we determine that it has become outdated.
Personal data arising from a contract concluded with us or our distributor will be processed for the period during which claims related to that contract may arise, i.e., for the duration of the cooperation, the warranty/complaint period, and the period required by tax regulations.
Data Recipients
Your personal data may be disclosed to our partners, distributors, and carriers.
Your data may also be accessed by our subcontractors (data processors), e.g., accounting, legal, IT companies, claims adjusters, service providers handling claims, insurance companies.
Your personal data may also be disclosed to supervisory and control authorities.
Transfer of Data to Third Countries (Outside the EEA)
Personal data may be transferred to third countries if necessary for the performance of a contract or if required to conclude or perform a contract entered into in the interest of the data subject between the Controller and another natural or legal person.

Under GDPR, you have the right to:
- access your data and receive a copy,
- rectify (correct) your data,
- erase data, restrict processing,
- object to data processing,
- data portability,
- file a complaint with the supervisory authority – the President of the Personal Data Protection Office.
You have the right to withdraw consent at any time.
